Should I Get a Property Survey in Texas?

, May 4, 2023

When purchasing a property, it’s crucial to understand every aspect of the process and the property itself. One question that frequently arises for buyers is: should I get a property survey? While the answer can depend on a variety of factors, this article aims to provide a comprehensive overview of property surveys and their importance, with a focus on Texas.

What is a Property Survey?

A property survey is a detailed drawing of a property that shows the location of the home, other structures, and property lines. It reveals any encroachments or easements—rights others may have to use parts of your property. In Texas, a survey is not required by law when you buy a property, but your lender or title company may require one.

Importance of a Property Survey

Even if it’s not a requirement, there are several reasons why you might want to consider getting a property survey. Here are a few:

  • Avoid Disputes: A survey can help you avoid potential disputes with neighbors over property lines. Conflicts over land boundaries can lead to costly and time-consuming legal battles.
  • Discover Encroachments and Easements: The survey may reveal any easements or encroachments you weren’t aware of. Knowing these ahead of time can prevent future problems.
  • Detailed Record: A property survey provides a detailed record of your property for future reference, which can be helpful in planning any additions or modifications to the property.

Cost of a Property Survey

The cost of a survey can vary depending on the size and complexity of the property. It’s typically a few hundred to a few thousand dollars. The cost is usually the buyer’s responsibility, but sometimes the seller may agree to pay for it as part of the negotiation process. It’s important to weigh the cost of a survey against the potential cost of property disputes or issues that might arise without one.

Using an Existing Survey

What if the seller already has a survey? It might not be necessary to commission a new one, depending on the age of the survey and whether there have been any changes to the property. However, your lender or title company might require a new survey, regardless of whether an existing one is available.

If the seller has a recent survey and there have been no changes to the property, the title company might accept a “survey affidavit”. This is a legal document where the seller confirms that no changes have been made to the property since the survey was done.

Condos and Property Surveys

When purchasing a condominium, a traditional survey is typically not necessary. Instead, you should receive a plat or map of the condo unit itself, which shows the boundaries and features of the unit. This should be included in the condominium documents, which also typically include information about the common areas, the rules and regulations of the condo association, and other key details.

Resolving Survey Problems

If you’re under contract to buy a home and a problem shows up on the survey, you have several options. You can negotiate with the seller, request a title resolution, cancel the purchase, or accept the issue, depending on the severity and impact of the problem.

Conclusion

While a property survey might not be a legal requirement in Texas, it’s often a crucial part of the home buying process. Whether it’s to satisfy your lender’s requirements, to uncover potential issues, or to ensure peace of mind, getting a property survey can be a wise investment. As always, consult with a real estate professional or attorney to make sure you’re making the best decisions for your situation.

We recently worked with Xuan (Swan) Redding from Bramblett to sell our house in the Cedar Park area. Throughout the process Xuan was on top of every situation. Xuan’s knowledge & persistence proved to work to our advantage & benefit. She was very thorough and provided options & suggestions when requested without being pushy. We always had the final say & she respected all of our decisions. 100% Recommended.

My wife and I have been extremely happy with our realtor Sally Pierce and the company she works for; Bramlett Residential Real Estate. They were able to sell our home in this tough market and make the transition smooth. They are at the top of their game. We highly recommend them both for your Real Estate needs.

I don’t often write reviews but had to write a review for Xuan Redding at Bramlett Residential Real Estate. Xuan is an excellent realtor that knows the market well and provides great insight as to what is worth buying and what is not. Based on just a few meetings and reviewing a few properties, Xuan knew exactly what I was looking for and was able to find a great deal for me. I felt at ease very quickly when working with Xuan. Xuan gives no pressure but gives sound advice treating my money as if it were her own. I trust Xuan to do the right thing and to advise in an honest way. She is not just focussing on a sale like so many are these days, she even went above and beyond to get me a discount on the house I got without me even asking for it! Now that is incredible!

It had been a while since I had bought a property and Xuan led and drove through the entire process, helping to coordinate with inspector, title company and lender facilitating almost everything. Xuan provided lists of choices for title company, inspectors and lenders but in no way pressured me to use any of them. Xuan also spent time to create videos to explain parts of the process that needed additional explanations (Contracts etc). She was happy to do in person or over the phone but I was busy traveling so this made it very convenient for me. The explanations were very clear and concise.

I cannot recommend Xuan enough! Whether you are looking for your own home or property investor, Xuan is the one for you!

If you want incredible service, support, and real estate expertise, I would highly recommend Teri Schock of Bramlett Residential Real Estate. We have worked with her on 4 separate occasions, and she continues to exceed expectations. She makes selling and buying homes a collaborative effort, advocating for your best interests, and providing valuable guidance every step of the way. She really listens to your needs and ensures you are not only satisfied with your decisions, but genuinely wants you to be happy.

Vikki Davis just helped me close on a non typical property. She was extremely helpful throughout, very responsive to communications, personable and pleasant to work with. I will be using her again.

Tammy at Bramlett Residential is the best real estate agent we have ever had!!! Cannot recommend enough! 10 stars! Thank you for everything Tammy!

It helps to have a go to realtor / team that can provide recommendations on everything real estate. I’ve worked closely with Steffan Schmieding. He was very responsive and knowledgeable of the market. I got all my questions answered and received the right recommendations on the property requested. Highly recommend!!

We were moving from CA, and after a few conversations with Betsy, she knew exactly what we wanted, by listening to us. We came out on our only home visit, and every home we saw fit our needs, and by the afternoon, we fell in love with our soon to be home. No time was wasted, and we were grateful, because we had to pack so much in a small amount of time. She even negotiated a deal, I didn’t think was possible with a new home builder saving us thousands! When it came down to find a temporary rental until our home was built…I trusted her completely. She negotiated a short term lease, in an area we highly desired. We are renting from the home right now and could not be any more satisfied! Betsy works hard by making sure you get what you want and is surprisingly (don’t be fooled by her smile) relentless in negotiating for you…that’s the type of realtor I want working for me.

We were introduced to Betsy by a family member (she helped him buy his condo) when we decided to relocate to the Austin area from the Midwest. From the beginning, she was responsive, helpful, and her knowledge of the Austin real estate market was impressive. We decided to rent for a few months, before buying a house. Betsy helped us find a great rental property. She took video of a couple of properties and we were able to select one with confidence even though we were out of state at the time. When we were ready, she helped us buy a home in Circle C. I cannot express how wonderful of an agent she was. She was indispensable during the entire process. Especially when the negotiation process got really difficult. This was our third time buying a home, and we had never used an agent before. I think we would have walked away from the deal had Betsy not been there to walk us through it all. To top it all off, Betsy even helped us find a new agent to sell our home in the Midwest! Our original agent was not working out and the house sat on the market for 5 months without a single offer. She interviewed agents and made a recommendation. After switching agents we got an offer within a week. We are now in the process of selling the house finally! Needless to say, we highly recommend Betsy Gallagher for buying or selling your home!
